You bought it from a store with a sign, a register, and a state license. The package said hemp-derived. Then a traffic stop, a K-9 alert, and a charge for possession of a controlled substance, Penalty Group 2 — a felony. Brian Foley explains the gap in this video.
Two different bodies of law
Texas legalized hemp — cannabis with 0.3% or less delta-9 THC by dry weight — in 2019, and retailers sell "hemp-derived" products under that framework. But the Texas Controlled Substances Act still lists tetrahydrocannabinols other than marijuana in Penalty Group 2, and possession of any usable quantity of THC concentrate is a state jail felony at minimum. A vape cartridge, gummy, or dab that tests over the limit — or that contains a THC isomer the lab reports as "THC" without distinguishing its source — is charged under the Controlled Substances Act, not the hemp statute.
Why the store's license doesn't help you
The retailer's protection comes from the hemp licensing scheme and, in practice, from the difficulty of prosecuting a business. The buyer's exposure comes from what is in the product. The label is the seller's claim, not a lab result. If DPS or the Galveston Forensic Science Center tests the product and reports THC, the receipt is not a defense — at best it is mitigation on the question of what you knew.
How these cases are defended
- Knowledge. The State must prove you knowingly possessed a controlled substance. A product bought over the counter, labeled as legal hemp, is strong evidence you did not know it was contraband.
- The lab. Many labs cannot reliably distinguish hemp-derived THC from marijuana-derived THC, or quantify delta-9 versus other isomers. The testing method and its limitations are cross-examined.
- The search. Vape cases begin with a stop and a search; both are challenged.
- Diversion. Galveston County offers programs for first-time possession cases that end in dismissal.
